Over the last decade the divorce rate in thailand has jumped from 27% in 2006 to 39% in 2016. More than 33% of Thai couples who registered their marriage in 2016 sought legal separation in Thailand during that same year.

In Thailand there are two types of divorce. These are known as Contested Divorce (which can be quite expensive) and Uncontested Divorce which is much less expensive and can be typically known as Divorce by Mutual Consent or Administrative Divorce.

Uncontested Divorce in Thailand 

An uncontested separation is the authoritative type of separation in Thailand. It is a separation by common assent and it is favored on the grounds that it is quick and clear. The couple should both be present while applying for an uncontested separation. It is directed at the nearby enlistment office which is known as the amphur, amphoe or khet.

The main requirement for the Uncontested Divorce in Thailand or the administrative Thai divorce is the legal registration of the marriage in Thailand and it was duly registered in accordance with the Thai Civil and Commercial Code. The documents to be submitted are as follows:

If returning to the same district office where the marriage was registered:

  • Both original marriage certificates
  • ID card for the Thai national
  • Thai party’s Tabien baan (blue book or household registration documents)
  • The passport of the Foreign National

If divorcing in a district office different from where the marriage was registered:

  • Both original marriage certificates
  • ID card for the Thai national
  • Thai party’s Tabien baan (blue book or household registration documents)
  • The passport of the Foreign National
  • Legalized translation of the foreigner’s passport copy
